Redes interdisciplinares e reflexão sobre a prática pedagógica.Silvia Branco Vidal Bustamante - 2022 - Human Review.

Menke’s reconstruction of Benjamin’s law, his tragic aporia and recognition.Gonzalo Bustamante Kuschel - 2015 - Philosophy and Social Criticism 41 (6):577-591.
Benjamin’s Critique of Violence (1921) has been a relevant source of legal and political philosophy about the nature of law, from Derrida to Menke. In this article, we rebuild the reading of Benjamin’s Critique proposed by Menke and consider the appropriateness of violence in the law not as a tragic tension, but as a condition for its reproduction. Finally, we will consider its paradoxical nature as a confirmation of the difference between the force of law and social-normative elements such as (...)

    Entre espectros y asedios. Jacques Derrida y la sobrevida.Carmen Gloria Ruiz Bustamante - 2019 - Ideas Y Valores 68 (170):37-58.

IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...)

This paper explores the political thought of Michel Foucault, which is anchored on his philosophy of subjectivation or the transformation of individuals into subjects. It presents his ideas of the State from the point of view of specific strategies and practices of power used in the transformation of individuals into subjects. It also presents his analysis of government as an organization that looks after the achievement of individual's goals and interests. The goal of government is not to achieve the common (...)

Rank and Dimension in Difference-Differential Fields.Ronald F. Bustamante Medina - 2011 - Notre Dame Journal of Formal Logic 52 (4):403-414.
Hrushovski proved that the theory of difference-differential fields of characteristic zero has a model-companion, which we shall denote DCFA. Previously, the author proved that this theory is supersimple. In supersimple theories there is a notion of rank defined in analogy with Lascar U-rank for superstable theories. It is also possible to define a notion of dimension for types in DCFA based on transcendence degree of realization of the types. In this paper we compute the rank of a model of DCFA, (...)

  17. The Ethics of Attention: Engaging the Real with Iris Murdoch and Simone Weil.Silvia Caprioglio Panizza - 2022 - New York, NY, USA: Routledge Studies in Ethics and Moral Theory.
This book draws on Iris Murdoch's philosophy to explore questions related to the importance of attention in ethics. In doing so, it also engages with Murdoch's ideas about the existence of a moral reality, the importance of love, and the necessity but also the difficulty, for most of us, of fighting against our natural self-centred tendencies. Why is attention important to morality? This book argues that many moral failures and moral achievements can be explained by attention. Not only our actions (...)
  18. Mathematical and Moral Disagreement.Silvia Jonas - 2020 - Philosophical Quarterly 70 (279):302-327.
The existence of fundamental moral disagreements is a central problem for moral realism and has often been contrasted with an alleged absence of disagreement in mathematics. However, mathematicians do in fact disagree on fundamental questions, for example on which set-theoretic axioms are true, and some philosophers have argued that this increases the plausibility of moral vis-à-vis mathematical realism. I argue that the analogy between mathematical and moral disagreement is not as straightforward as those arguments present it. In particular, I argue (...)

New essays on the Fish-Dworkin debate.Thomas da Rosa de Bustamante & Margaret Martin (eds.) - 2023 - New York: Hart Publishing, An Imprint of Bloomsbury Publishing.
This book considers the seminal debate in jurisprudence between Ronald Dworkin and Stanley Fish. It looks at the exchange between Dworkin and Fish, initiated in the 1980s, and analyses the role the exchange has played in the development of contemporary theories of interpretation, legal reasoning, and the nature of law. The book encompasses 4 key themes of the debate between these authors: legal theory and its critical role, interpretation and critical constraints, pragmatism and interpretive communities, and some general implications of (...)

Narrative autonomy and artificial storytelling.Silvia Pierosara - forthcoming - AI and Society:1-10.
This article tries to shed light on the difference between human autonomy and AI-driven machine autonomy. The breadth of the studies concerning this topic is constantly increasing, and for this reason, this discussion is very narrow and limited in its extent. Indeed, its hypothesis is that it is possible to distinguish two kinds of autonomy by analysing the way humans and robots narrate stories and the types of stories that, respectively, result from their capability of narrating stories on their own. (...)

  30. Moral Perception Beyond Supervenience: Iris Murdoch’s Radical Perspective.Silvia Panizza - 2019 - Journal of Value Inquiry 54 (2):273-288.
Among the possible ways of gaining moral knowledge, moral perception figures as a controversial yet fruitful option. If moral perception is possible, moral disagreement is addressed not by appealing to principles but to the process and the objects of perception, and moral progress occurs not through deliberation but by refining one’s perceptual faculties. The possibility of “seeing clearly and justly” is at the heart of Iris Murdoch’s thought, but Murdoch herself does not put forth a systematic argument for this view. (...)

An important yet often unacknowledged aspect of moral discourse is the phenomenon of moral impossibility, which challenges more widely accepted models of moral discussion and deliberation as a choice among possible options. Starting from observations of the new possibilities of anti immigrant attitudes and hate crimes which have been described by the press as something being “unleashed,” the paper asks what it means for something to enter or not the sphere of possibility in the moral sense, and whether it is (...)

    Bioethics, Genetics and Sport.Silvia Camporesi & Mike McNamee - 2018 - Routledge.
Advances in genetics and related biotechnologies are having a profound effect on sport, raising important ethical questions about the limits and possibilities of the human body. Drawing on real case studies and grounded in rigorous scientific evidence, this book offers an ethical critique of current practices and explores the intersection of genetics, ethics and sport. Written by two of the world's leading authorities on the ethics of biotechnology in sport, the book addresses the philosophical implications of the latest scientific developments (...)
  33. Reflections on Feminist Merleau-Ponty Skepticism.Silvia Stoller - 2000 - Hypatia 15 (1):175-182.
Shannon Sullivan's critique of Merleau-Ponty's Phenomenology of Perception is based on the argument that, due to his concept of the “anonymous body,” his theory of intersubjectivity omits the particularities of bodies, such as gender. I argue that Merleau-Ponty's “anonymous body” is not in fact “neutral” as Sullivan suggests, and moreover that he does not ignore differences but rather provides us with the idea of difference as a process of differentiation. Additionally, I argue that Sullivan's concept of “hypothetical construction,” which is (...)

Attention, for Iris Murdoch, is a central concept in more than one sense. On the one hand, it appears to be one of the keys, if not the key, to goodness, the task of the moral subject, and the pre-requisite for right action. On the other, attention can function as the hinge around which Murdoch’s general ethical worldview (including psychology and metaphysics) can be made to revolve, and through which it turns away from the mainstream contemporary philosophy of her time. Pluralist mathematical realism, the view that there exists more than one mathematical universe, has become an influential position in the philosophy of mathematics. I argue that, if mathematical pluralism is true (and we have good reason to believe that it is), then mathematical realism cannot (easily) be justified by arguments from the indispensability of mathematics to science. This is because any justificatory chain of inferences from mathematical applications in science to the total body of mathematical theorems can cover at most (...)

Ronald Dworkin’s philosophy of law, in its mature version, is grounded in at least two central claims: first, a thesis about law and morality, which we might call the One-System Thesis; second, a thesis about how moral and legal propositions can be said to be true or false, which we might call the Interpretive Thesis. While the One-System Thesis holds that law and morality form a single system, the Interpretive Thesis makes two distinct claims: first, truth of interpretive propositions—such as (...)

This paper aims to bring a novel approach to the discussion of unfair advantages in sport by looking for a local criterion of fairness instead of a universal criterion. A local criterion of fairness would not solve the general dispute over what counts as an unfair advantage, but it would be beneficial in evaluating specific cases and could guide further discussion about them. We seek a local criterion of fairness by comparing the specific property advantages of Caster Semenya and Eero (...)
